DEFINITIONS:
Participant: The person whom has chosen to attend Warriors Fitness Club (WFC) with the use of any of the memberships offered by WFC. FEES:
The participant acknowledges membership fees are paid via direct debit, two (2) weeks in advance, or for 6- or 12-months upfront. The participant understands sufficient funds must be in their nominated account by the due date to enable the direct debit to be honoured on the debit date. The participant further acknowledges debit and credit cards have fees associated with their nomination, and fees associated with fortnightly direct debit payments may differ from any one off payments/purchases. The participant also acknowledges there is an annual administration fee of $50.00, payable upon membership commencement, and is paid annually on the anniversary of each membership with WFC. MEMBERSHIP:
The participant understands their membership allows them to attend an unlimited number of classes for the duration of their membership, in accordance with the WFC membership purchased. The participant acknowledges membership can be placed on hold for a minimum of two (2) weeks, up to a maximum of four (4) weeks per year. Participants also understand WFC staff must be provided with a minimum of two (2) weeks written notice in order to place memberships on hold. The participant understands that membership may be cancelled at any time, which will incur a $0 cancellation fee. In order to cancel membership, the participant acknowledges they must provide WFC staff with four (4) weeks written notice. Participants also understand WFC memberships are non-refundable or transferable to another student under any circumstance. Should classes only be attended sporadically during any week/month of membership, the participant understands they are utilising said membership, and unattended classes cannot be redeemed/refunded/transferred for use at a later date. CONTACT DETAILS:
The participant understands WFC must be informed of any change to address, telephone number, and email address, along with any other information relevant to their membership with WFC. The participant further acknowledges the primary method of communication from WFC will be via email, and the participant acknowledges their responsibility to inform WFC staff on joining if regular access to email is unattainable. If incorrect contact details are provided, or if the participant fails to check this method of communication on a regular basis, the participant accepts responsibility of not receiving said communication. HEALTH DETAILS:
The participant acknowledges the need to provide the trainers at WFC correct and current health information. The participant further acknowledges WFC cannot be held responsible for any injury or illness that may arise if incorrect or misleading health information is provided. The participant understands WFC must be informed, as soon as reasonably possible, of any new or developing injury/illness/allergy, to allow WFC staff to reasonably ensure the participant's health and safety during participation in classes and/or personal training sessions. CONDITIONS OF PARTICIPATION:
Participation in WFC classes will involve physical activity and/or participation in martial arts. WFC management and staff will provide all reasonable and appropriate instruction to ensure each participant's health and safety. However, the participant understands that participation in any physical activity at WFC holds the risk of personal injury in the course of instruction and, with this knowledge, agrees to assume the risk of any injury and damages to the participant during the class, personal training session, event, and/or seminar. Specifically, the participant agrees to hold harmless WFC and all other individuals, organizations, sponsors, promoters, operators, hosts, instructors, associations, schools, owners, officials, directors, employees and other participants connected with the class from all losses, damages, injuries, causes of actions, claims, or complaints in the event that the participant is damaged or injured in any way during the participation, instruction and/or performance of any exercise or during any activity associated with the class location or during transit to or from the class. Participant further agrees to strictly obey instructors and observe safety rules. Because of the physical demands of the programs run by WFC, the participant understands that he/she must be in good physical condition to participate in classes, events, seminars, gradings, training camps, tournaments, and any other occasion run by WFC. The participant understands that in case of injury, the only medical treatment WFC will provide is first aid. In the event the participant is under the age of 18 years and membership terms and conditions must be agreed to by the parent and/or guardian of the WFC member/participant, it is the parent/guardian's responsibility to ensure their presence at the premises during classes in which their child/ren are participating, in the event of an emergency, or during any circumstances in which their child/ren require their attention and/or intervention. Furthermore, parents and/or guardians must be present to pick up their child/ren after class and ensure their safe return home. WFC management and staff are not responsible for the safety of members at class finish times in the event of a parent/guardian's absence. If, in a period of absence, a member under the age of 18 years requires medical attention, the parent/guardian authorize WFC management to call an ambulance, if deemed necessary, to ensure their health and safety. KARATE GRADINGS:
The participant, and/or parents/guardians of participants, understand that a 'Grading' is the event whereby Kyokushin Karate students of WFC test for their next rank. The participant further understands that participation in karate gradings is done so at your own risk, and is subject to the conditions of participation. Participants and/or parents/guardians of participants understand that by completing and submitting a grading application form to WFC, he/she agree to abide by the rules of the grading and declare they are physically fit and healthy to participate in such a grading, and have not been advised otherwise by a health professional. MARKETING/PROMOTION STRATEGY:
The participant understands that management reserves the right to take photos/videos of activities during classes, which may be used in marketing/advertising material. The participant agrees that any pictures, audio, or visual recordings taken of him/her in connection with the class can be used for publication, promotion, articles, shows and advertisement without additional consent and without compensation at this time or any other time. The participant further understands that WFC management must be advised in writing should he/she not wish for his/her photo/video to be taken during his/her participation in classes. CHANGE OF RULES:
The participant understands WFC reserves the right to change terms and conditions of membership at any time, without requiring notice. The participant also acknowledges his/her responsibility check current terms and conditions of membership, which can be found on the WFC website. INVESTMENT INCREASE:
The participant understands WFC management reserves the right to increase membership dues at any time, and will inform affected participants in writing of any increase with as much notice as WFC management can reasonably provide. The participant acknowledges that if membership fees are increased, the increased fees will not be applicable to the weeks/months for which have already paid. RIGHT OF ADMISSION:
The participant acknowledges WFC reserves the right to refuse admission to any person, including members, and has the right to cancel any membership without warning or notice to due to inappropriate behaviour, unpaid fees, failure to comply with WFC etiquette, or for any other reason that WFC management may decide. CONFIDENTIALITY:
The participant acknowledges WFC will keep any and all personal information provided completely confidential, and that WFC management will make all reasonable efforts to ensure that any and all staff members of WFC who have access to the participant's personal information do not make any unauthorized use, notification, reproduction or disclosure of information, and personal information will only be used for the purposes of ensuring members' health and safety for the duration of each class, and to ensure proper and correct management of each membership, respectively. In the event of injury/illness during class participation whereby WFC staff are required to seek medical attention on the participant's behalf, the participant authorises WFC to disclose personal information to treating medical professional for more precise/effective medical treatment. PERSONAL TRAINING:
The participant understands that Personal Training (PT) sessions are appointment-based sessions, scheduled at a time that suits both the trainer and the participant. If the participant is unable to attend the PT appointment, the participant understands that he/she must provide trainers with 24 hours notice in order to allow the appointment to be rescheduled, else the appointment fee is forfeited. 6-WEEK TRANSFORMATION CHALLENGE
LOYALTY PROGRAM:
If a current member refers a friend, that current member will receive two weeks free membership. The referred friend/friend's family must become a member/s of WFC, and mention the referring friend by name in order for the current member to claim the loyalty promotion. In the event the current member has two or more family members also members of WFC, the promotion is only valid for one member of the referring family. Additionally, if the referred friend has multiple members of their family joining, the two weeks free is applicable per one family joining WFC. 2-WEEK FREE TRIAL:
Group Fitness Classes offer a 2-Week Free Trial to all new customers (aged 16+ years). This 2-Week Free Trial allows each new customer to attend as many group fitness classes as is available during any consecutive 14-day period. At the end of the 14-day free trial period, the 2-Week Trial Membership expires and the customer must purchase a membership in order to continue attending classes at WFC. |
